Terms of service
Date: 2025-09-23
1. About These Terms
These Terms of Service (“Terms”) govern your use of selfrose.store (“Site”) and any purchases you make from us (collectively, “Services”). By accessing, browsing, or using the Site, creating an account, placing an order, or engaging with any of our Services, you (“you”, “user”, “customer”) agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Site or Services.
These Terms apply to all users, including browsers, customers, content contributors (e.g., users who leave product reviews), and anyone accessing the Site on behalf of a business (e.g., purchasing decor for an office). If you are using the Site or Services on behalf of a business, you represent that you have the authority to bind the business to these Terms, and “you” will refer to the business.
We may also reference additional policies (e.g., Privacy Policy, Shipping Policy, Return Policy) within these Terms—these policies are incorporated into these Terms by reference and form part of your agreement with us. In the event of a conflict between these Terms and a referenced policy, the referenced policy will control for that specific matter.
2. Eligibility to Use the Site & Services
To use the Site or purchase products, you must meet the following eligibility requirements:
- Age: Be at least the age of majority in your state, province, or country of residence (typically 18 years old). If you are under the age of majority, you may use the Site only with the supervision and written consent of a parent or legal guardian, who will be fully responsible for your compliance with these Terms and any purchases made using their payment method.
- Legal Capacity: Have the legal capacity to enter into a binding contract. This means you cannot be under guardianship, a minor without parental consent, or mentally incapacitated (as defined by applicable law).
- Accurate Information: Provide true, accurate, current, and complete information when creating an account, placing an order, or contacting customer support. This includes (but is not limited to) your full name, email address, billing/delivery address, phone number, and payment details.
We reserve the right to verify your eligibility (e.g., requesting proof of age or identity) and suspend or terminate your access to the Site if you fail to meet these requirements or provide false information.
3. Prohibited Uses of the Site & Services
You may not use the Site, Services, or our products for any unlawful, fraudulent, or abusive purpose. Specifically, you agree not to:
3.1 Violate Laws or Third-Party Rights
- Break any applicable federal, state, local, or international laws, regulations, or ordinances (e.g., reselling products in violation of local licensing requirements, importing restricted items, or using the Site to facilitate money laundering).
- Infringe the intellectual property rights of selfrose.store or third parties (e.g., copying product photos, logos, or website design without our written permission; using copyrighted content in product reviews without the copyright owner’s authorization; or selling counterfeit versions of our products).
- Violate the privacy, publicity, or other rights of third parties (e.g., sharing another person’s personal data without their consent, posting photos of others in product reviews without permission, or impersonating a third party).
3.2 Misuse the Site or Services
- Resell, distribute, lease, or rent our products for commercial purposes (e.g., buying bulk quantities of decor to sell on eBay, Amazon, or other platforms) without our explicit written permission. If you wish to become a reseller, contact us at service@selfrose.store to apply for our reseller program.
- Transmit viruses, malware, worms, Trojan horses, or other destructive code that could harm the Site, our servers, or other users’ devices (e.g., uploading a file with a virus to a product review, sending malicious links via our contact form, or using the Site to distribute malware).
- Access or attempt to access restricted areas of the Site (e.g., admin panels, database servers, or internal order management systems) without authorization. This includes using automated tools (e.g., bots, scrapers) to bypass login requirements or extract data from the Site.
- Use automated tools (e.g., bots, scripts, or macros) to collect data from the Site (e.g., scraping product prices, descriptions, or user reviews) or automate purchases (e.g., using bots to buy limited-edition products before other users).
- Interfere with the Site’s functionality (e.g., overloading servers with excessive requests, disrupting navigation, or manipulating search results to promote specific products).
3.3 Engage in Fraudulent or Abusive Behavior
- Impersonate another person or entity (e.g., using a fake name, email address, or profile photo to create an account; pretending to be a selfrose.store employee or representative; or using a stolen identity to place orders).
- Place fraudulent orders (e.g., using a stolen credit card, providing a fake billing/delivery address, placing multiple duplicate orders to manipulate inventory, or claiming non-receipt of products that were delivered).
- Harass, threaten, defame, or discriminate against other users, our staff, or third parties (e.g., leaving threatening or offensive product reviews, sending abusive emails to customer support, or posting content that targets individuals based on race, gender, religion, disability, or other protected characteristics).
- Spam the Site or other users (e.g., posting repetitive product reviews, sending unsolicited marketing messages to other customers via the Site’s contact form, or flooding our social media links with irrelevant comments).
- Abuse our return policy (e.g., returning used or damaged products as “unused,” returning products purchased from other retailers as our own, or placing frequent orders with the intent to return most items).
A breach of any of these prohibitions will result in immediate termination of your access to the Site and Services. You will also be liable for any damages we incur as a result of your violation (e.g., legal fees to defend against a third-party copyright claim, costs to repair a hacked server, or losses from fraudulent orders). We may also report serious violations (e.g., fraud, malware distribution) to law enforcement agencies.
4. Product Information & Pricing
4.1 Product Descriptions
We strive to provide accurate, detailed descriptions of our products (e.g., dimensions, materials, colors, functionality, care instructions) on the Site. However, we do not guarantee that all product information is error-free, complete, or up-to-date. For example:
- Material descriptions may use general terms (e.g., “wooden frame” may refer to oak, maple, or pine) unless a specific material is explicitly stated.
- Color descriptions may vary due to manufacturing batches (e.g., “navy blue” may have slight shade differences between orders) or natural variations in materials (e.g., handmade ceramics may have unique color patterns).
- Dimensions are approximate and may vary by up to 1 inch due to manual measurement or manufacturing tolerances.
If you have questions about a product (e.g., “Is this rug machine-washable?” “Does this lamp use a standard light bulb?” “Will this shelf support 50 pounds?”), contact service@selfrose.store before purchasing. We are not liable for misunderstandings arising from incomplete or slightly inaccurate product descriptions unless the error is intentional or the result of gross negligence.
4.2 Product Images
We make every effort to display product colors and images accurately, but your device’s monitor settings (e.g., brightness, contrast, color temperature, or resolution) may cause colors to appear differently in person. Additionally:
- Images may include accessories (e.g., a vase with flowers, a candle with a holder, or a pillow with a throw blanket) that are not included with the product—always check the product description for a list of included items.
- Images may show products in styled settings (e.g., a table in a living room, a mug on a kitchen counter) to illustrate size or use—actual product dimensions are listed in the description (e.g., “12 inches tall, 8 inches wide”).
- Images of handmade or artisanal products may not exactly match the item you receive, as these products often have unique variations (e.g., hand-painted designs, natural wood grain patterns).
4.3 Pricing
- Currency: All prices on the Site are displayed in U.S. Dollars (USD), unless otherwise specified. If you are purchasing from outside the U.S., your payment provider may convert the price to your local currency and charge a conversion fee—we are not responsible for these fees.
- Inclusions/Exclusions: Prices include the cost of the product but exclude sales tax, shipping fees (except for explicitly stated “Free Shipping” offers), and any applicable customs duties or import fees (for international orders). Sales tax is calculated at checkout based on your delivery address (in compliance with U.S. state and local tax laws) and is added to the total order amount.
- Price Changes: We reserve the right to change prices at any time without notice. Price changes do not affect orders that have already been confirmed (i.e., orders for which you have received an “Order Confirmation” email).
- Price Errors: If a product is listed at an incorrect price due to a typo, technical error, or miscommunication (e.g., a $100 product listed as $10), we reserve the right to cancel the order and refund any payment you made. We will notify you of the error within 24 hours of order placement and offer to reprocess the order at the correct price (if you wish). If you do not wish to proceed at the correct price, we will issue a full refund.
- Promotions & Discounts: Promotional codes, sales, and discounts are valid only for the period specified in the promotion terms and may have restrictions (e.g., minimum purchase amount, excluded products, or one-time use per customer). We reserve the right to cancel or modify promotions at any time, even if the promotion period has not expired, if we suspect abuse (e.g., sharing discount codes publicly, creating multiple accounts to use the same code).
4.4 Product Availability
-
Stock Status: Product availability is indicated on the Site as “In Stock,” “Out of Stock,” or “Pre-Order.”
- “In Stock”: The product is available for immediate shipping (typically within 2–5 business days).
- “Out of Stock”: The product is currently unavailable. You may sign up for “Back in Stock” notifications (if available) to be alerted when the product is restocked.
- “Pre-Order”: The product is not yet available but can be ordered in advance. The expected shipping date is listed on the product page—we will ship the product as soon as it is in stock. If the shipping date is delayed, we will notify you via email.
- Quantity Limits: We may limit the number of products you can purchase per order or per household (e.g., “Maximum 2 per customer” for limited-edition items or “Maximum 5 per order” for bulk-priced products) to prevent bulk reselling and ensure fair access for all customers. If you attempt to exceed these limits, we may cancel the excess items or the entire order.
- Discontinuation: We reserve the right to discontinue products at any time, with or without notice. If a product you ordered is discontinued after confirmation, we will notify you immediately and offer a full refund or a comparable alternative product (if available). If you choose an alternative, we will adjust the order amount (refunding any difference if the alternative is cheaper or charging the difference if it is more expensive) with your consent.
5. Order Placement & Confirmation
5.1 Order Process
When you place an order on the Site, you are making an offer to purchase our products. We reserve the right to accept or reject your offer for any reason, including:
- Product unavailability (e.g., the last item was sold to another customer before your order was processed, or the product was discontinued after you placed the order).
- Suspected fraud (e.g., mismatched billing and delivery addresses, a credit card flagged for fraud by our payment provider, an order placed from a high-risk IP address, or a new account placing a large order without prior contact).
- Inaccurate product information (e.g., a pricing typo, incorrect product description, or misleading image).
- Violation of these Terms (e.g., you have a history of placing fraudulent orders, returning used products, or violating our resale policy).
- Technical errors (e.g., a glitch in the checkout process that duplicated your order or charged the wrong amount).
If we reject your offer, we will notify you via email within 24 hours and refund any payment you made (if applicable) within 3 business days.
5.2 Order Confirmation
Your order is only confirmed when you receive an email titled “Order Confirmation” from us (sent to the email address you provided at checkout). This email includes:
- Your unique order number (e.g., SR-12345).
- Product details (name, model, quantity, price, and any customizations).
- Shipping address and estimated delivery date.
- Billing address and payment method (last 4 digits of the card or PayPal ID).
- Total amount due (including product cost, sales tax, and shipping fees).
If you do not receive a confirmation email within 24 hours of placing your order:
- Check your spam/junk folder (confirmation emails are sometimes filtered incorrectly by email providers like Gmail or Outlook).
- Verify that you provided the correct email address at checkout (log in to your account, if you have one, to check your order history).
- Contact service@selfrose.store with your full name, the date of your order, and the products you tried to purchase to verify the order status.
5.3 Order Changes & Cancellations
- Before Shipping: You may request to change or cancel your order only if it has not yet been shipped. To do so, email service@selfrose.store with your order number and the desired change (e.g., “Update my delivery address to 123 Main St, Apt 4B,” “Add a gift note to my order,” or “Cancel order SR-12345”). We will confirm the change or cancellation via email if approved. We cannot guarantee changes or cancellations for orders that are already in the “Processing” stage (e.g., being packed for shipping).
- After Shipping: Once your order has been shipped (i.e., you have received a “Shipment Confirmation” email with a tracking number), we cannot change or cancel it. You will need to follow our Return Policy to return the product for a refund or exchange (if eligible).
6. Billing & Payment
6.1 Billing Information
You agree to provide true, accurate, current, and complete billing information when placing an order. This includes:
- Full name as it appears on your payment method (e.g., credit card, PayPal account).
- Billing address (must match the address on file with your payment provider—discrepancies may result in payment decline or order cancellation).
- Payment method details (e.g., credit card number, expiration date, CVV code; PayPal email address; Apple Pay/Google Pay credentials).
We use this information to verify your payment method (e.g., ensuring the credit card is not stolen, confirming the PayPal account is in good standing) and comply with financial regulations (e.g., anti-money laundering laws, PCI DSS requirements). If your billing information is inaccurate or incomplete, we may delay or cancel your order until correct information is provided.
6.2 Accepted Payment Methods
We accept the following payment methods (as indicated on the checkout page):
- Credit Cards: Visa, Mastercard, American Express, Discover.
- Debit Cards: Cards with Visa or Mastercard logos (must be enabled for online purchases by your bank).
- Third-Party Payment Services: PayPal, Apple Pay, Google Pay.
All payments are processed by PCI DSS-compliant third-party providers (e.g., Stripe, PayPal). We never store full credit card details on our servers—your financial data is encrypted and secured by the payment provider, in compliance with global security standards.
6.3 Payment Authorization
By placing an order, you authorize us to charge your selected payment method for the total order amount (including product cost, sales tax, shipping fees, and any other applicable charges, such as gift wrap fees). We may place a temporary hold on your payment method (e.g., a $1 authorization for credit cards) to verify funds before processing the full charge. This hold is typically released within 1–3 business days if the order is canceled or the payment is declined.
If your payment is declined (e.g., insufficient funds, expired card, fraud alert, or incorrect billing address), we will notify you via email. You must provide an alternative payment method within 7 days of the notification—otherwise, we may cancel your order and notify you of the cancellation.
6.4 Billing Disputes
If you believe you were charged incorrectly (e.g., double-charged, charged for a canceled order, or charged the wrong amount), contact service@selfrose.store with your order number, a description of the dispute, and any supporting documentation (e.g., a screenshot of your bank statement showing the charge). We will investigate the issue within 3 business days and issue a refund if the charge is confirmed to be incorrect.
Do not dispute the charge with your payment provider (e.g., filing a chargeback with your credit card company) before contacting us. Unauthorized chargebacks may result in a “chargeback fee” (typically $25–$50, charged to us by the payment provider), which we may pass on to you if the dispute is resolved in our favor (e.g., the charge was valid, and you filed a chargeback without good reason). We may also terminate your access to the Site if you abuse the chargeback process.
7. Disclaimer of Warranties
THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SELFROSE.STORE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
7.1 Implied Warranties
- Merchantability: The warranty that products will be fit for their ordinary intended use (e.g., a mug will hold liquid, a shelf will support light weight). We do not warrant that products will be free from minor defects (e.g., a small scratch on a wooden surface, a slight imperfection in a handmade ceramic) that do not affect functionality.
- Fitness for a Particular Purpose: The warranty that products will meet your specific needs (e.g., a “waterproof” rug will withstand outdoor rain, a “child-safe” toy will not pose a choking hazard). This warranty applies only if you explicitly informed us of your specific needs before purchasing, and we confirmed in writing that the product would meet them.
- Accuracy: The warranty that product descriptions, images, pricing, or availability information is error-free, complete, or up-to-date. As noted in Section 4, minor inaccuracies (e.g., color variations, typographical errors) may occur.
- Title: The warranty that we have the right to sell the products and that they are free from liens or claims by third parties. We warrant that we own or have the right to distribute all products sold on the Site.
7.2 Express Warranties
We only provide express warranties if explicitly stated in writing on the product page or in a separate document (e.g., a product manual). For example, we may offer a “1-year warranty against manufacturing defects” for certain products. Such warranties are limited to the terms specified (e.g., duration, covered defects, and remedy—e.g., replacement or refund) and do not cover damage from misuse, neglect, or normal wear and tear (e.g., a broken mug from being dropped, a faded rug from direct sunlight).
Your use of the Site, Services, and products is at your sole risk. We are not liable for any damages resulting from your reliance on the Site, dissatisfaction with the products, or inability to use the Services, except as required by applicable law (e.g., warranties for consumer products that cannot be disclaimed under state law).
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY U.S. LAW, SELFROSE.STORE, ITS EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, SERVICES, OR PRODUCTS. This includes, but is not limited to:
- Damages from product defects (e.g., a broken lamp causing minor property damage—our liability is limited to replacing the lamp or issuing a refund).
- Loss of profits or revenue (e.g., a delayed order preventing you from using a product for a special event, or a defective product causing you to lose a resale opportunity).
- Inconvenience, emotional distress, or loss of enjoyment (e.g., frustration from a canceled order, disappointment with a product that does not match your expectations).
- Damages from site downtime or errors (e.g., inability to place an order during a sale, data loss from a site glitch).
- Damages from third-party actions (e.g., a shipping carrier losing your package, a payment provider charging incorrect fees).
This limitation applies even if we were advised of the possibility of such damages, and regardless of the legal theory (e.g., contract, tort, negligence, strict liability) on which the claim is based.
In jurisdictions where limitation of liability is prohibited (e.g., some states for personal injury or property damage caused by our negligence), our liability shall be limited to the maximum extent permitted by law. For example, if a product defect causes personal injury, our liability may not be limited, but we will still not be liable for indirect or punitive damages.
9. Indemnification
You agree to indemnify, defend, and hold harmless selfrose.store, its employees, directors, officers, agents, suppliers, and affiliates from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees, court costs, and settlement amounts) arising from:
- Your violation of these Terms or any applicable laws, regulations, or ordinances.
- Your use of the Site or Services (e.g., a product review that defames a third party, unauthorized access to the Site using your account).
- Your purchase or use of our products (e.g., a product you resold causing harm to a third party, damage to property from improper use of a product).
- Your breach of any representation or warranty in these Terms (e.g., providing false billing information, claiming a product is defective when it was damaged by misuse).
- Your failure to pay any amounts owed to us (e.g., unpaid orders, chargeback fees).
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in defending such matter (e.g., providing documentation, testifying if necessary). You may not settle any claim without our prior written consent.
10. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect. The invalidity of one provision does not affect the validity or enforceability of the other provisions. For example, if a court finds that our limitation of liability for indirect damages is unenforceable, the rest of the Terms (e.g., order confirmation requirements, prohibited uses) will still apply.
11. Termination
These Terms are effective until terminated by either you or us:
11.1 Termination by You
You may terminate these Terms at any time by:
- Ceasing to use the Site and Services (e.g., no longer visiting the Site, placing orders, or accessing your account).
- Closing your customer account (by emailing service@selfrose.store with your request to close the account—we will confirm closure within 3 business days).
Closing your account does not relieve you of any obligations incurred before termination (e.g., paying for orders placed before closure, indemnifying us for prior breaches).
11.2 Termination by Us
We may terminate these Terms immediately without notice if:
- You violate any provision of these Terms (e.g., placing a fraudulent order, infringing our intellectual property, abusing our return policy).
- You provide false or misleading information (e.g., a fake name, address, or payment method).
- We determine that your use of the Site or Services poses a risk to us, other users, or third parties (e.g., your account is linked to a data breach, you are using the Site to distribute malware).
- You fail to pay any amounts owed to us (e.g., unpaid orders, chargeback fees) within 14 days of notification.
Upon termination:
- You must stop using the Site and Services immediately.
- We may delete or deactivate your account, and you will no longer have access to your order history or saved preferences.
- We may retain your data for legal purposes (e.g., order records for tax compliance) as required by law.
- You remain liable for any amounts due (e.g., unpaid orders, damages from breaches) up to the date of termination.
Obligations and liabilities incurred prior to termination (e.g., payment for orders, indemnification) shall survive termination for all purposes.
12. Entire Agreement
These Terms and our referenced policies (Privacy Policy, Shipping Policy, Return Policy) constitute the entire agreement between you and selfrose.store regarding your use of the Site and Services. They supersede all prior or contemporaneous agreements, communications, and proposals (oral or written) between you and us, including any prior versions of these Terms, verbal promises from customer support, or promotional materials that conflict with these Terms.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party (selfrose.store). For example, if a term is unclear, it will be interpreted in a way that is fair to both parties, not just against us.
13. Governing Law & Disputes
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of laws principles. This means that any dispute arising from these Terms will be interpreted under California law, even if you live in another state or country.
13.2 Dispute Resolution
- Informal Resolution: Before initiating any legal action, you agree to contact us at service@selfrose.store to attempt to resolve the dispute informally. We will respond to your inquiry within 5 business days, and we will work with you in good faith to reach a mutually acceptable solution (e.g., a refund, replacement, or discount on a future order). Most disputes can be resolved quickly through this process.
- Small Claims Court: If the dispute cannot be resolved informally, you may file a claim in small claims court in your county of residence (or in Los Angeles County, California, if you are outside the U.S.) if the claim amount is within the court’s jurisdiction (typically $10,000 or less for individuals). Small claims court is a low-cost, informal way to resolve disputes without an attorney.
- Class Action Waiver: You agree that you may not bring a class action, collective action, or representative action against us. Any dispute must be brought individually, not as part of a class. This means you cannot join a lawsuit with other customers or act as a representative for a group of customers.
- Arbitration (Optional): If informal resolution and small claims court are unsuccessful, you and we may agree to resolve the dispute through binding arbitration instead of litigation. Arbitration is a private process where a neutral arbitrator decides the dispute, and the decision is final. If you wish to arbitrate, contact us for details on the arbitration process.
You agree that the statute of limitations for filing any claim arising from these Terms is 1 year from the date the claim arises. After 1 year, the claim is permanently barred.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in legal requirements (e.g., new state privacy laws), business practices (e.g., adding a new payment method), or Site features (e.g., launching a loyalty program). When we make changes:
- We will post the revised Terms on the Site with a new “Last Updated” date prominently displayed at the top.
- We will notify account holders of material changes (e.g., new prohibited uses, changes to liability limits, or updates to order confirmation requirements) via email at least 7 days before the changes take effect. The email will include a summary of the key changes and a link to the full revised Terms.
- For non-material changes (e.g., minor updates to contact information, clarifications to existing provisions), we will post the revised Terms on the Site without additional notification.
Your continued use of the Site or Services after the revised Terms are posted constitutes acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Site and Services immediately. We encourage you to review these Terms periodically (e.g., every 6 months) to stay informed about your rights and obligations.
15. Contact Information
